BIKE HIRE AGREEMENT

Bikes & equipment can only be hired from Hut 55 on completion of a Hire Agreement. Upon acceptance of these Terms & Conditions a binding contract is formed between Hut 55 & the hirer for the duration of the hire. Terms apply to both bikes & e-bikes.

The Hire period commences the day or time the cycle(s) and equipment is collected & continues until the cycle(s) and equipment is returned to Hut 55. We reserve the right not to accept or to fulfil a Booking.

Rider Responsibilities:

1. Each rider agrees that they are physically & mentally capable of riding the hire bike. You should not ride if you are in ill health, have a disability likely to affect ability to cycle, or your eyesight is not up to the standard required by a road driving test. It is the rider’s responsibility for their own safety. Cycling involves personal risk and you must ride responsibly.

2. Please follow the highway code. Be courteous to pedestrians & other road users. Do not attempt any manoeuvres beyond your skill level or the bike’s capabilities.

3. The rider is fully responsible for their action whilst using the hire bike. Hut 55 does not accept responsibility for the actions of the participant or any member of their party, nor the consequences of such actions. You agree to indemnify Hut 55 against any liabilities, costs, expenses, damages and losses arising out of or in connection with the death or injury to any person or any damage to property resulting from your hire or use of the equipment.

4. Each rider is responsible for providing their own insurance protection while using a hire bike. Any accident or injury caused by the rider’s actions will be the full responsibility of said rider. Each rider will be fully responsible for any fees or costs incurred from an accident either involving or caused by the rider.

5. Hut 55 advises riders to wear a helmet at all times - riders who choose not to wear helmets, do so at their own risk. Riders may use their own helmets, or helmets may be borrowed from Hut 55 with no additional fee & should be returned with the bikes.

6. The rider may not participate in this activity if under the influence of alcohol, drugs or strong medications which may impair your ability to cycle.

7. First time or novice bikers should use the equipment under the supervision of an experienced rider. Children under the age of 18 must be supervised at all times while using the equipment. Children under the age of 14 are not permitted to hire e-bikes.

8. Hut 55 staff are usually available by phone or email to help out with any problems during the hire period; however it is the customer’s responsibility to keep a check on the bike they have hired, and to monitor battery life while using an e-bike. Whilst Hut 55 will always do its best to have staff available during the hire period this cannot be guaranteed.

Rider Responsibility for Damage, Loss and Theft:

9. Bikes are rented out clean and in proper working condition and must be returned in the same manner. We ask our customers to treat the equipment responsibly and with respect.

10. Hut 55 will provide equipment which has been maintained in a roadworthy condition, however, it is the responsibility of the rider to check the bike before setting out on any ride. If you feel at any point prior to leaving the premises that this obligation has not been met, please raise your concerns with the staff and we will seek to resolve this & provide alternative equipment. If during your hire period, the bike suffers a catastrophic failure that does not pertain to fair wear and tear, please cease riding immediately and contact Hut 55 for further instruction. You will be responsible for your own repair of fair wear and tear e.g. punctures, using the repair kits provided.

11. The rider agrees to return the bike by the agreed upon time. Late return of the bikes may result in additional hire fees. Please always notify Hut 55 asap if you are unable to return the bikes at the agreed upon time or wish to extend the rental period.

12. The rider agrees to return the bike in an undamaged condition to avoid any additional charges for repair, maintenance or replacement. Undamaged condition means normal wear and tear is accepted but does not include broken spokes, rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes. Damaged parts or components will be repaired/replaced at the shop’s discretion and customer agrees to pay regular shop rates and retail prices for components replaced. Failure to return the bike will result in Hut 55 recovering the full retail value of the bike from the rider.

13. The rider accepts complete responsibility during the period of hire for the safe custody of the equipment and for any loss, theft or damage (howsoever caused). You are responsible for the security of the bicycle(s) and must lock it/them to a fixed object whenever unattended and keep the equipment safeguarded at all times. Any loss, theft, damage or accident should be notified to Hut 55 immediately and in the case of theft or accident to the nearest police station. In case of theft, the rider will be responsible for reimbursing Hut 55 for the original price of the bikes, plus the cost of any accessories that were provided at the time of the bike rental.
